Purpose
These terms govern access to and use of the BizzyTrainer platform: voice simulation of meetings with an artificial intelligence, automated analysis and scoring of sessions, meeting preparation and management of training teams. The financial terms — plans, prices, payment, cancellation of the subscription — are governed by the terms of sale.
Acceptance
Use of the service constitutes acceptance of these terms. They apply to every user, whether their account was created directly or upon invitation from an organization.
Accounts and roles
The account is personal: its credentials may not be shared, and the user is responsible for the activity carried out under their account. Within an organization, rights depend on the role assigned by that organization:
- member — accesses their own sessions, recordings and scores;
- supervisor (manager, teacher) — accesses the organization's sessions, including recordings and transcripts;
- administrator and owner — additionally manage members, the subscription and the settings.
Assigning roles and informing users about these access rights are the responsibility of the customer organization.
Use of the service
It is prohibited, in particular:
- to attempt to circumvent security, quota or isolation mechanisms;
- to access or attempt to access another organization's data;
- to use the service to generate unlawful or defamatory content, or content that infringes third-party rights;
- to resell access to the service without KEAJY's written consent.
Third-party data. Some features allow a meeting to be prepared from information about a real prospect. The user and their organization warrant that they are entitled to enter this information and assume the obligation to inform the persons concerned, in accordance with personal data regulations.
Sessions and recordings
Every simulation is recorded: audio of the conversation, full transcript, analysis and score. Recording is inherent to the service and cannot be disabled. The user is informed by these terms; informing an organization's employees or students is the organization's responsibility.
Results produced by artificial intelligence
- Analyses and scores are produced automatically, without human intervention prior to their display. They are training aids, not binding professional assessments: they may contain inaccuracies and guarantee no commercial or academic result.
- The customer organization that gives its supervisors access to its members' results alone decides how it uses them. If it bases on a score a decision that significantly affects a person, it is responsible for organizing the human intervention and the means of redress required by regulations.
- KEAJY trains no artificial intelligence model on customer data.
Quotas
The volume of simulations and preparations depends on the plan subscribed, detailed in the terms of sale. Counters are tallied per organization.
Availability and evolution
KEAJY endeavors to keep the service available but does not guarantee uninterrupted access: maintenance, incidents and technical dependencies (artificial intelligence providers in particular) may affect it. The service evolves continuously; KEAJY may add, modify or remove features without altering the nature of the service subscribed.
Intellectual property
The service, its software, its trademark and its visual elements are the property of KEAJY. Content created by the customer within the service — counterparts, scenarios, events — and the customer's session data are the property of the customer. The customer grants KEAJY the right to host and process them for the sole purpose of providing the service.
Personal data
The processing of personal data is described in the privacy policy. Data processing commitments toward customer organizations are the subject of a dedicated agreement, provided in the contractual documentation.
Suspension and termination
KEAJY may suspend an account in the event of a serious breach of these terms, after a notice that has remained without effect, except in an emergency justified by security. Cancellation of the subscription is governed by the terms of sale; what happens to the data at the end of the contract is described in the contractual documentation.
Liability
KEAJY is bound by a best-efforts obligation. It is liable neither for decisions made by the customer or its organization on the basis of the analyses produced, nor for content entered by users, nor for unavailability attributable to third parties. KEAJY's total liability, on any grounds whatsoever, is limited to the amounts actually paid by the customer during the twelve months preceding the event giving rise to the claim. Indirect damages — loss of revenue, customers, business, data or reputation — are excluded.
Changes to these terms
KEAJY may amend these terms. The applicable version is the one published on this page; material changes are notified to customer organizations before they take effect.
Governing law and disputes
These terms are governed by French law. Any dispute relating to their interpretation or performance falls, failing an amicable resolution, within the jurisdiction of the Commercial Court of Créteil (tribunal de commerce de Créteil), France.
